By purchasing, accessing, or using an Agilivance course, examination, portfolio project, or other paid offering, you agree to these Terms of Use & Refund Policy (“Terms”). Agile Delivery Improvement Program, Enterprise Learning Solutions and other organizational engagements may also be subject to additional terms agreed with the organization.
- Pricing, currency, and taxes
- Program prices are shown in USD unless stated otherwise.
- Prices may change from time to time; the price at checkout is the price that applies to your order.
- Applicable taxes (e.g. VAT / GST / sales tax) may be calculated at checkout based on billing location and any tax configuration we use through our payment provider(s).
- You are responsible for any additional taxes, duties, or bank / currency conversion fees charged by your bank, card issuer, or country.
- Payments & billing
- Payments are processed securely by third-party payment providers (currently PayPal for online card and wallet payments) and/or manual bank transfer, depending on the options shown at checkout (for example, paying via PayPal or, where offered, paying via direct bank transfer after we share our bank details).
- Your PayPal account, card or bank statement may show AGILIVANCE or a similar descriptor used by the payment provider.
- You confirm that:
- you are authorized to use the payment method you provide;
- all billing information is true, accurate, and complete.
We may cancel enrolment or suspend access if a payment is reversed, disputed, or flagged as fraudulent.
- Accounts, enrolment & access
- An account may be created for you at checkout so you can access the online learning environment and certificates.
-
For individual purchases, access is provided to the individual learner named or registered for the purchase and may not be shared with other individuals.
-
For Enterprise Learning Solutions, access and permitted users will be determined by the applicable enterprise agreement, order, or proposal. Organization-provided access may be assigned to the authorized learners specified under that arrangement and may not be shared outside the authorized users.
- You are responsible for keeping your login details secure and for all activity under your account.
We may pause or terminate access where we reasonably suspect misuse, piracy, or violation of these Terms.
- License and permitted use
- For individual purchases, you receive a personal, non-transferable, non-exclusive license to access the purchased Program for your own learning.
- For Enterprise Learning Solutions, the organization and authorized learners receive the access and usage rights specified in the applicable enterprise agreement, order, or proposal.
You may not:
- share, resell, lease, or transfer your access or account;
- copy, download, record, redistribute, or publish course videos, slides, PDFs, templates, quizzes, exam questions, or other materials;
- use our content to create competing products, courses, coaching, or exams;
- remove or alter watermarks, copyright notices, or other provenance information.
All rights not expressly granted are reserved by Agilivance.
- Refund & cancellation policy (all programs)
Enterprise Learning Solutions and other organizational engagements may be subject to separate commercial terms, cancellation provisions, payment schedules, and refund arrangements agreed with the organization before delivery. Where such terms apply, they will take precedence over the individual Program refund provisions below.
Because our offerings may include digital content and expert time that cannot be “returned” once access is granted, we operate a no-change-of-mind refund policy. Except where required by applicable law, all sales are final and fees are non-refundable, subject to the limited cases below. In particular, there are no refunds for:
- change of mind, lack of time, or loss of interest;
- non-attendance or partial attendance at ILT sessions;
- dissatisfaction with your exam score, failure to pass, or not using the exam;
- dissatisfaction with personal career outcomes (e.g. not getting a job or promotion).
We will consider a refund or alternative remedy only if:
- We fail to deliver access to the purchased Program (e.g., you never receive login access or links), and
- You contact us at info@agilivance.com within 7 days of the purchase, and
- We are unable to resolve the access or technical issue within a reasonable time after you co-operate with troubleshooting.
Where required by law (for example, mandatory consumer rights in your country), those rights will apply and may override parts of this policy.
- Certificates and exam integrity
- Certificates are issued upon successful completion of the relevant Program requirements (for example, attendance + exercises + exam performance as specified for each Program). For some Programs, completing instructor-led sessions alone is not enough; you must also pass the associated exam within the specified timeframe to be certified.
- Where an Enterprise Learning Solution includes certification or certificates, the applicable certification requirements will be communicated as part of the relevant enterprise arrangement.
- We may verify and, where necessary, revoke or invalidate certificates in cases of:
- cheating, impersonation, or exam rule violations;
- plagiarism or submission of non-original work;
- misuse of certificates or Agilivance branding.
- Some Programs require you to book a specific exam date and time through our scheduling process after completing required learning (for example, an ILT cohort or Exam-Only option). You are responsible for:
- booking an available slot within any stated validity period;
- ensuring you have the required technology and environment at the scheduled time; and
- following any rescheduling rules we provide (for example, only rescheduling up to a certain time before your slot).
Failure to attend or complete the exam at the scheduled time, or missing rescheduling deadlines, does not generally entitle you to a refund. Issuance of a certificate does not guarantee job placement, promotion, salary increase, or a particular business outcome.
- Technology requirements & third-party tools
You are responsible for having suitable technology and connectivity, including for example:
- a stable internet connection;
- a compatible device and browser to access the LMS;
- audio/video capability and supported software (e.g., Zoom or similar) for ILT sessions;
- the ability to receive emails from info@agilivance.com and related addresses.
- access to the email account you use at checkout so you can receive scheduling links, exam instructions, and updates.
We rely on third-party platforms (such as hosting providers, LMS, video conferencing, and payment gateways). While we choose reputable providers, we cannot guarantee their continuous availability. Outages or issues at those providers do not automatically entitle you to a refund, but we will act reasonably to restore access or provide alternatives.
- Prohibited conduct
You agree not to:
- share login details or allow others to access your account;
- reproduce, distribute, or publicly display any Program materials;
- record or capture ILT sessions or LMS videos without our written consent;
- attempt to bypass security or access controls;
- use our materials to create competing courses, coaching services, or exam products;
- engage in harassment, abusive behaviour, or disruption during ILT sessions or in online communities linked to the Programs.
For Enterprise Learning Solutions, authorized organizational access may not be extended to individuals who are not covered by the applicable enterprise arrangement.
We may suspend or terminate access without refund for serious or repeated violations.
- Intellectual property
All Programs, content, trademarks, favicon, logos, designs, templates, questions, quizzes, certificates, and all other content supplied or made available through agilivance.com, our LMS, ILT sessions, or any related channels (the “Agilivance Materials”) are the intellectual property of Agilivance or our licensors and are protected by copyright, trademark, and other applicable laws. All rights in the Agilivance Materials are reserved.
Nothing in these Terms transfers ownership of any intellectual property to you. You receive only a limited personal license to use the Agilivance Materials for your own individual learning in connection with the Programs you purchase, subject to these Terms.
- Disclaimers & limitation of liability
We do our best to keep our Programs accurate, up to date, and accessible, but all Programs and related materials are provided on an “as is” and “as available” basis. This means we do not guarantee that the website, LMS, or ILT sessions will always be uninterrupted, error-free, or a perfect fit for every situation, company, or project.
We do not promise that participation in any Program will lead to a specific job, promotion, financial result, exam success, or other particular outcome.
To the maximum extent permitted by law:
- we are not liable for indirect, incidental, special, or consequential losses (including loss of profits, data, or business opportunities); and
- our total aggregate liability for any claim related to a Program is limited to the amount you actually paid for that specific Program.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so (for example, for intentional misconduct, fraud, or non-waivable consumer rights).
- Governing law & consumer rights
Any disputes relating to these Terms or our Programs will be handled in line with applicable law and any non-waivable consumer rights you have in your country or state.
Nothing in these Terms is intended to limit rights you are entitled to under mandatory consumer protection laws.
- Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top shows the latest version. Material changes will generally apply to new purchases from the date of publication; existing learners will be notified where a change materially affects them.
